Implementing integration clauses in public contracts

Article 14 of the new French Public Contracts Code allows the use of public-sector contracts to encourage the professional integration of people hitherto distanced from employment by incorporating an integration clause in invitations to tender.


Using public-sector contracts to encourage professional integration

This action reflects a political willingness to make public procurement more responsible, and is implemented by:

  • Greater Lyon,
  • SYTRAL,
  • SNCF,
  • all the main social landlords in the Lyon urban area, as well as
  • SEM Confluence and
  • the local councils.

Since its implementation in 2005, the integration clause has generated:

  • 1,330 contracts (all contractors combined),
  • which represents almost 640,000 hours of work.

Greater Lyon is one of the principal contractors, with a total of

  • 138,000 hours of work generated by integration clauses,
  • of which 62,000 hours were in 2008 alone.

A few figures

Population concerned by integration clauses:

  • predominantly male
  • 52% of people hired through integration clauses are jobseekers, half of whom have been looking for work for more than a year, and 20% of whom receive the RMI or income support
  • a third of these people are aged under 26
  • 36% have no qualifications, 48% are educated to BEP/CAP level
  • one in two comes from designated priority areas (such as Vaulx-en-Velin, Vénissieux and La Duchère)

Analysis of outcomes resulting from this measure:

  • proportion of positive outcomes: 46%. At the end of the integration period, 39% of participants had direct access to a sustainable job (CDI or CDD of at least 6 months), while 7% went on to obtain training and qualifications
  • a third of participants are continuing to work towards professional integration
  • 17% of participants left before the end of their contract
  • 8% did not meet their employers' requirements and had their contracts terminated

Widespread application of the social performance clause

Efforts are currently being made to ensure the widespread application of the clause d’exécution sociale (social performance clause) to all of the Urban Community's public contracts.

Thinking on this subject currently concerns the development of similar approaches in the context of service contracts, particularly contracts for intellectual services, in order to reach a different sector of the population: women and/or recent graduates.
